The Salty Lens Co. — Terms of Service
Effective Date: 1/2025
Photographer: Jenna Cavalancia (“Photographer”) and any authorized team members, stylists, makeup artists, or assistants operating under The Salty Lens Co. brand.
Client: The undersigned individual or entity (“Client”).
By booking a session, signing a contract, or submitting payment, the Client agrees to the following Terms of Service. These terms are designed to ensure a professional, safe, and transparent experience for both the Client and The Salty Lens Co.
If a signed contract or custom agreement contains additional terms, those provisions supersede any conflicting information contained here.
1. Booking, Contracts & Payments
1.1 Reservation & Retainer
A signed contract and non-refundable retainer are required to secure any booking.
Standard sessions start at $250.
Weddings and events start at $2,500.
Final pricing and package inclusions are specified in the Client’s signed contract.
1.2 Payment Schedule
Full payment is due:
30 days prior to the event/session date; or
Within 7 days of booking if scheduled within 30 days; or
Within 24 hours of booking if scheduled within 3 days.
Late payments may incur a 15% late fee and may result in cancellation with forfeiture of all funds paid.
1.3 Payment Methods
Card authorization is required for all payments and includes billing details and authorized amounts.
All retainers and payments are non-refundable, even in cases of cancellation or rescheduling.
2. Payment Plans & Authorizations
Payment plans may be available for bookings made 4+ months in advance.
Retainer: 35% due within 48 hours of contract signing.
Plan Options:
3-Month Plan: sessions booked 4+ months out
6-Month Plan: sessions booked 7+ months out
9-Month Plan: sessions booked 10+ months out
Missed payments, declined cards, or expired authorizations will result in cancellation of services and forfeiture of all funds paid.
2.1 Chargebacks & Breach of Contract
Any attempt to dispute or reverse a transaction after missed or incomplete payments, or after a session is forfeited for nonpayment, will be considered a breach of contract.
The Salty Lens Co. reserves the right to seek full recovery of:
Outstanding balances
Chargeback and bank fees
Administrative and legal costs
3. Image Delivery, Editing & Style
3.1 Delivery
Final images are delivered as high-resolution JPEGs only.
RAW or unedited files will never be released.
Typical delivery timelines:
Portrait Sessions: 6–10 weeks
Weddings & Events: 10–16 weeks
3.2 Editing & Artistic Style
All culling, editing, and creative decisions are made solely by the Photographer to reflect The Salty Lens Co.’s signature artistic style.
By booking, the Client acknowledges that they have reviewed and accept this style.
Session tones and color grading may vary due to lighting, environment, and creative direction. Re-edits will not be performed for stylistic differences or personal preference conflicts.
3.3 Gallery Issues & Requests
If the Client experiences missing downloads, access issues, or technical problems, they must contact the Photographer directly to seek resolution.
Requests for additional edits, file corrections, or adjustments may incur a fee.
The Salty Lens Co. will make every reasonable effort to assist but cannot guarantee re-editing or re-delivery beyond the scope of the contract.
3.4 File Storage
Final images remain available for download for a limited time after delivery. The Salty Lens Co. cannot guarantee permanent storage once the gallery link expires.
4. Image Use, Copyright & Licensing
All photographs remain the exclusive intellectual property of The Salty Lens Co.
Clients receive a personal-use license only, which permits:
Sharing with family and friends
Posting on social media (credit @TheSaltyLensCo required)
Printing for personal display
4.1 Prohibited Uses
The following actions are strictly prohibited without written consent:
Commercial, promotional, or resale use
Editing, cropping, or applying filters
Uploading or processing through AI tools or generators
Selling or distributing images in any format
Violations constitute copyright infringement and breach of contract, subject to legal and financial penalties.
4.2 Incidental Appearances
In events, styled shoots, or public sessions, individuals who appear incidentally in the background are not considered primary subjects.
Attendance or presence constitutes implied consent to be photographed unless a written objection is submitted beforehand.
The booking Client is responsible for notifying participants and securing any necessary permissions.
5. Model Release & Image Use Consent
By participating in a session, the Client grants The Salty Lens Co. the right to use selected images for portfolio, marketing, and educational purposes, including website, social media, print, and advertising materials.
If the Client wishes to restrict usage, a written opt-out must be discussed and provided before final gallery delivery. Once released, usage rights cannot be retroactively revoked.
5.1 Minors
For sessions involving minors:
The signing parent or guardian grants consent for participation and image use.
If a minor attends under the supervision of another adult, that adult is responsible for obtaining consent from the child’s parent/guardian.
Written notice declining photography must be submitted prior to the session.
Failure to provide notice constitutes consent under this agreement.
6. Session Timing, Overtime & No-Shows
6.1 Punctuality
Clients must arrive prepared and on time.
Late arrivals over 15 minutes may result in reduced coverage.
Arrivals exceeding 30 minutes without notice are considered no-shows and forfeit all payments.
6.2 Overtime
Extended coverage may be arranged at the Photographer’s discretion:
Standard sessions: $150 per 30 minutes
Weddings/events: $250 per 30 minutes (2-hour minimum)
Payment for overtime is due prior to gallery release.
6.3 No-Show & Rescheduling
No-shows or day-of cancellations result in forfeiture of all funds.
Rescheduling may be available for an additional $150 fee, depending on availability.
7. Conduct, Safety & Professional Boundaries
The Salty Lens Co. maintains a professional, safe, and respectful environment at all times.
7.1 Client & Guest Conduct
The Client and all attendees must behave respectfully toward the Photographer, assistants, and stylists.
Harassment, inappropriate comments, intoxication, or unsafe behavior will result in immediate termination without refund.
7.2 Studio & On-Location Rules
The Client is fully responsible for the actions, behavior, and compliance of all participants, guests, and attendees during the session or event. This includes ensuring that all individuals follow property, venue, and studio rules at all times.
Any damage, loss, or additional fees resulting from the actions, negligence, or misconduct of the Client or their guests will be billed directly to the Client and must be paid in full upon receipt of invoice.
The Photographer reserves the right to immediately suspend or terminate the session if any damage, unsafe behavior, or violations of property rules occur. In such cases, all payments will be forfeited, and the Client may be held financially responsible for any resulting costs or repairs.
7.3 The Empowerment Experience (Boudoir) & Untamed Sessions
These sessions often explore artistic expression through vulnerability, sensuality, or implied nudity. By booking, the Client acknowledges and consents to this artistic nature.
The Photographer and Pose & Styling Director prioritize comfort and consent at all times. No physical contact or posing adjustments will be made without permission.
All images remain professional, artistic, and created in a safe environment. Any inappropriate behavior or solicitation will result in immediate termination and forfeiture of all fees.
Boudoir (“The Empowerment Experience”) sessions are restricted to individuals who are 18 years of age or older. These sessions may include mature, implied, or sensual themes and are reserved exclusively for adult clients.
Untamed sessions may vary in creative direction and artistic concept. While not all Untamed sessions are 18+, certain themes or concepts may involve mature or implied content and will therefore require participants to be 18 years of age or older. Identification may be requested prior to participation to verify eligibility based on the shoot’s content and concept.
8. Injury, Damage & Client Responsibility
The Client agrees to ensure a safe, secure, and hazard-free environment for all photography sessions and events, including all associated travel, setup, and teardown activities.
Coverage of responsibility begins the moment the Photographer or authorized team member departs for the Client’s session or event and continues until their safe return to their home or base of operations.
If any injury, damage, or loss occurs at any point during travel, setup, active shooting, or teardown — whether or not the Client or their guests are directly involved — the Client shall be held financially responsible for all resulting costs as outlined below.
8.1 Medical Incidents & Insurance Coordination (Revised)
If the Photographer, assistant, or stylist sustains an injury while performing services related to the Client’s booking, The Salty Lens Co. and its team members will first utilize any applicable personal, business, or liability insurance coverage available to them.
Once any applicable insurance has been processed, the Client is responsible for all remaining balances, uncovered expenses, and deductibles associated with that injury or incident. This includes, but is not limited to:
Medically necessary treatment or care as determined by a licensed healthcare provider;
Out-of-pocket medical expenses not covered by insurance (including deductibles and co-pays);
Lost income or business interruption during recovery or required downtime; and
Reasonable transportation or lodging costs directly related to the injury or its treatment.
This responsibility applies regardless of whether the injury occurs on-site, during travel, setup, active shooting, or teardown, provided it is directly connected to the performance of the Client’s session or event.
All determinations regarding the necessity, provider selection, and scope of care are made by the injured party and their healthcare professionals, not by the Client.
8.2 Equipment, Property, and Hardware Damage
If any photography, lighting, or production equipment is damaged, lost, or destroyed during travel, setup, or the event itself, the Client shall be responsible for the full repair or replacement cost of the affected item(s).
All determinations regarding repair, replacement, and valuation are made solely by The Salty Lens Co. or the affected team member.
Replacement will be limited to either the identical model or, if unavailable, the closest comparable professional-grade model at current market value.
The Client has no authority to select repair vendors, dispute replacement choice, or limit reimbursement amounts for damaged or destroyed hardware.
8.3 Scope of Liability
The Photographer reserves the right to seek full recovery of any damages, repair costs, losses, or associated expenses caused directly or indirectly by unsafe conditions, guest actions, venue hazards, or Client negligence.
This responsibility applies whether incidents occur on-site or in transit to or from the Client’s session or event.
9. Limitations of Liability & Refund Policy
All retainers and payments are non-refundable as they secure time, preparation, and resources.
Refunds are not guaranteed but may be discussed in extraordinary cases such as verified emergencies or Photographer error.
Any refund or credit issued is at the Photographer’s discretion.
The Salty Lens Co. is not responsible for:
Weather, venue restrictions, or interference from guests
Equipment failure, natural disasters, or file loss
Subjective dissatisfaction with creative choices
Liability is limited to the total amount paid, excluding retainers and completed work.
10. Rescheduling & Cancellations
Requests must be made 48+ hours before the session.
Late changes or multiple reschedules may incur a $250+ fee.
Weather-related reschedules are granted at the Photographer’s discretion.
All payments remain non-refundable; reschedules are accommodated based on availability.
11. Weddings & Events
The Salty Lens Co. brings structure, artistry, and calm direction to every wedding and event, ensuring that each moment is captured with intention, professionalism, and ease from start to finish.
11.1 Pre-Event Consultation
A pre-event consultation (via phone, video, or in-person) is required for all weddings and large events.
This meeting allows The Salty Lens Co. and the Client to review event details, photography priorities, timeline expectations, and creative goals.
It also ensures that all involved parties have a clear understanding of desired coverage and deliverables.
11.2 Timeline & Coordination
A finalized photography timeline must be submitted no later than four (4) weeks prior to the event date.
The Client is responsible for assigning one to two reliable points of contact (such as a planner, coordinator, or trusted guest) to assist with communication, group coordination, and logistics throughout the event day.
The Salty Lens Co. will work closely with these designated contacts to manage transitions, direct group photos, and ensure an efficient flow of coverage.
11.3 Meals & Breaks
For events exceeding four (4) consecutive hours of coverage, the Client must provide a vendor meal and allow short break periods for the Photographer and any team members present.
Breaks will be taken at a time that does not interfere with critical moments but are essential to maintaining consistent performance, focus, and professionalism throughout the day.
11.4 Travel & Accommodations
Travel beyond a one-hour radius of Naples, Florida incurs a travel fee of $50 per 75 miles (round trip) plus any additional expenses related to lodging, parking, tolls, or transportation.
For events extending late into the evening or taking place at locations requiring significant travel, overnight accommodations may be required to ensure safety and readiness.
All travel and lodging arrangements must be finalized no later than four (4) weeks prior to the event.
11.5 Delivery Timeline
Final edited wedding or event galleries will be delivered within 10–16 weeks following the event date, depending on the scale, season, and complexity of coverage.
Rush processing, if available, may be offered at an additional fee upon request and subject to Photographer availability.
11.6 Overtime & Billing
All event coverage time begins at the scheduled start time and runs consecutively until the contracted coverage period concludes.
Time spent traveling between venues, managing unforeseen delays, or waiting on event progress is considered active coverage time and counts toward the contracted hours.
If the event runs longer than anticipated and additional time is requested by the Client or required to complete coverage:
Overtime will be billed at the rate specified in the signed contract.
Overtime invoices must be paid within 24 hours of issuance.
All galleries, albums, and products will be withheld until outstanding balances are paid in full.
11.7 Coverage Scope
Coverage begins when the Photographer or team arrives on-site at the first contracted location and continues consecutively until coverage ends.
Coverage does not extend beyond the agreed time unless additional hours are purchased in writing.
If multiple photographers, assistants, or stylists are present, they operate under The Salty Lens Co. direction and follow the same timeline unless otherwise specified in the contract.
Coverage includes:
Event preparation, ceremony, reception, and other agreed moments;
Travel time between venues during the contracted period;
Detail and candid photography as available during coverage hours.
Coverage does not include unscheduled or after-hours events unless agreed upon in writing and paid in advance or through an approved overtime invoice.
11.8 Destination & Multi-Day Event Addendum
For weddings or events requiring air travel, overnight stays, or multiple days of coverage, the following additional terms apply:
Travel Days:
Travel to and from destination locations will be billed at a half-day rate per travel day, unless otherwise negotiated in writing. This rate accounts for transit, packing, and setup time required to safely transport professional equipment.Airfare, Transportation & Baggage:
Round-trip airfare, checked baggage for photography and lighting equipment, local ground transportation, and any reasonable travel expenses (including transfers and meals while traveling) must be covered by the Client.
All travel arrangements—including choice of airline, baggage carrier, vehicle rental, and travel class—will be made at the discretion of The Salty Lens Co. or its authorized team members, unless otherwise agreed upon in the signed contract.Lodging & Accommodations:
The Client must provide or reimburse for lodging at or near the event venue for the full duration of coverage.
Lodging arrangements must be clean, safe, climate-controlled, and include access to reliable power and internet for secure file management and data backups.
While the Photographer may consider Client lodging preferences, the final selection of accommodations remains at the discretion of The Salty Lens Co. to ensure adequate rest, safety, and equipment protection.Schedule Flexibility:
The Client acknowledges that travel-related circumstances—such as flight delays, weather interruptions, or transportation cancellations—may impact scheduling or coverage.
In such cases, The Salty Lens Co. will make every reasonable effort to adjust and continue coverage; however, refunds or compensation for travel-related delays are not guaranteed.Extended Coverage:
Additional shooting days or event-related sessions (such as welcome dinners, engagement shoots, rehearsal dinners, or day-after sessions) may be added at the rates listed in the signed contract or agreed upon in writing prior to travel.Final Agreement:
All travel and lodging details will be confirmed in the final signed contract, which supersedes general terms listed here. Any exceptions, upgrades, or special arrangements must be discussed and agreed upon in writing before travel begins.
12. Data Privacy & Confidentiality
The Salty Lens Co. protects all personal and financial data using secure, encrypted systems. Only authorized team members have access to personal information.
Third-party systems (e.g., Square, Squarespace, gallery delivery, and payment processors) may handle necessary data under their own privacy terms.
13. Force Majeure & Substitution
In the event that The Salty Lens Co. or any authorized team member is unable to perform contracted services due to circumstances beyond their control — including but not limited to illness, injury (including incidents occurring during travel as described in Section 8), accidents, death in the family, natural disasters, transportation failures, venue restrictions, or other acts of God — this clause shall apply.
13.1 Substitution & Rescheduling
If performance becomes temporarily impossible due to a covered circumstance, The Salty Lens Co. will make every reasonable effort to:
Reschedule the session or event at a mutually agreeable time; or
Provide a qualified replacement photographer or assistant who upholds the same professional and artistic standards.
13.2 Insurance & Medical Coverage Coordination
If a force-majeure event involves injury or illness to the Photographer or team, The Salty Lens Co. will first seek coverage through any applicable personal, business, or liability insurance policies held by the Photographer or affected team member.
However, when the cause of the injury, accident, or loss is determined to stem from unsafe conditions, negligence, or actions by the Client, their guests, or their venue, the Client remains financially responsible for any uncovered or excess costs, as detailed in Section 8 (Injury, Damage & Client Responsibility).
This includes, but is not limited to:
Unreimbursed medical expenses deemed medically necessary by a licensed provider;
Repair or replacement of damaged or destroyed equipment;
Income loss, travel, or rescheduling costs incurred as a result of the event.
13.3 Refunds, Credits & Limitations
All retainers and payments are non-refundable, as they reserve the Photographer’s time and preparation.
If services cannot be completed or rescheduled, The Salty Lens Co. may, at its sole discretion, offer:
A partial credit toward a future session, or
A custom resolution based on work completed and documented circumstances.
Refunds are not guaranteed and will only be considered in good faith when no portion of the contracted services has been fulfilled.
In all cases, The Salty Lens Co.’s total liability is limited to the value of services not yet rendered, excluding retainers, completed work, or expenses already incurred.
13.4 Communication & Good Faith
In all force-majeure situations, The Salty Lens Co. will communicate promptly with the Client to discuss any rescheduling, substitution, or resolution options in good faith and maintain transparency throughout the process.
14. Social Media, Promotion & Portfolio Use
The Salty Lens Co. encourages Clients to share their images proudly, but maintaining artistic integrity and professional credit is essential to preserving the authenticity of the work.
When sharing or displaying images captured by The Salty Lens Co., the Client agrees to the following terms:
Proper Credit: All shared images must visibly credit @TheSaltyLensCo on social media, websites, and publications.
No Alterations or Filters: The Client may not crop, edit, recolor, or apply filters of any kind that alter the Photographer’s original work. This includes adjustments made through editing software, presets, or third-party applications.
No AI Use or Modification: Images captured by The Salty Lens Co. may not be uploaded to, processed by, or manipulated with any Artificial Intelligence (AI) tools, generators, or enhancement software.
This includes (but is not limited to) programs such as Midjourney, DALL·E, Firefly, Photoshop Generative Fill, or any comparable platform used to modify, “train,” or recreate imagery.
Using The Salty Lens Co. images in any AI system, dataset, or derivative project constitutes copyright infringement and breach of contract.
Promotional Use by Photographer: The Photographer retains the right to use images for promotional, portfolio, website, publication, and marketing purposes unless the Client provides a written opt-out before final gallery delivery. Once images are released, promotional use is considered permanently granted.
Mutual Credit: When The Salty Lens Co. shares or promotes Client images publicly (e.g., on social media or website features), the Photographer will include Client credit or tags when appropriate, relevant, or requested in writing.
Third-Party & Commercial Use: Any brand, vendor, or publication wishing to use Client images for advertising, resale, or collaborative purposes must obtain prior written approval or a separate commercial-use license from The Salty Lens Co.
Violations of these terms—including unauthorized editing, AI use, or removal of credits—may result in removal of shared content, cancellation of ongoing services, and/or legal action to enforce copyright and contractual rights.
15. Dispute Resolution, Chargebacks, and Non-Disparagement
Open, respectful communication is the foundation of The Salty Lens Co.’s client relationships. If any issue arises, the Client agrees to contact The Salty Lens Co. directly to attempt good-faith resolution before pursuing any form of public complaint, chargeback, or legal claim.
15.1 Chargebacks and Payment Disputes
Any attempt to dispute, reverse, or initiate a chargeback after services have been rendered, images delivered, or work initiated constitutes a breach of contract.
In such cases, The Salty Lens Co. reserves the right to pursue legal action and recover:
All disputed funds and chargeback fees;
Reasonable attorney’s fees and court costs;
Collection costs and damages incurred due to the dispute.
Clients who initiate chargebacks or payment disputes may also be permanently blacklisted from future bookings and services provided by The Salty Lens Co. or its affiliates.
15.2 Non-Disparagement & Public Conduct
The Client agrees not to publish, post, or share any negative, misleading, or defamatory statements—online or otherwise—about The Salty Lens Co., its Photographer(s), staff, or services.
This includes but is not limited to:
Social media posts or reviews;
Comments on public forums;
False or exaggerated claims intended to harm reputation or business.
Posting defamatory or harmful content, or participating in campaigns to damage reputation, will result in immediate termination of services, denial of future bookings, and may lead to legal action and recovery of damages under applicable defamation and contract laws.
15.3 Good-Faith Resolution
Both parties agree to first seek private communication and, if necessary, mediation before escalating to formal legal proceedings. The Salty Lens Co. maintains a commitment to resolving concerns professionally and respectfully, but will take all necessary steps to protect its brand, business, and creative integrity.
16. Client Acknowledgment & Agreement
By booking a session, signing a contract, or submitting payment, the Client acknowledges and agrees to the terms outlined in this document.
By doing so, the Client confirms that they:
Are at least 18 years of age and legally authorized to enter into this agreement;
Have read, understood, and accepted all policies and terms herein;
Assume full responsibility for the conduct, safety, and behavior of all participants and guests involved in the session or event;
Release The Salty Lens Co., the Photographer, and any associated team members from any liability, injury, or dissatisfaction beyond the agreed contractual terms.
This acknowledgment serves as a binding agreement and remains enforceable for all present and future services provided by The Salty Lens Co. unless superseded by a newly signed contract.
17. Entire Agreement & Governing Law
This agreement, together with any signed contracts, addendums, or written communications between the Client and The Salty Lens Co., constitutes the entire understanding between both parties regarding the services described herein.
No verbal agreements, prior discussions, social media messages, or informal communications shall override or modify the terms of this document unless confirmed in writing and signed by both parties.
If any provision of this agreement is found to be invalid or unenforceable, all remaining provisions shall remain in full effect and continue to be binding.
This agreement is governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles.
The parties agree that any legal action, mediation, or proceeding arising from this agreement shall be brought exclusively in the courts of Collier County, Florida, unless otherwise required by law.
By proceeding with booking, payment, or signature, the Client acknowledges full understanding and acceptance of these Terms of Service in their entirety.
